******* SURINDER GUPTA, J.(Oral) Learned counsel for the appellant submits that the matter has since been finally settled by the parties vide compromise dated 15.09.2016, which was produced before the executing Court and the decree by payment of `1,20,000/- stood fully satisfied. She further submits that amount of `1 lac was deposited by the appellant as per order dated 08.05.2012 passed in this appeal and the parties vide compromise dated 15.09.2016 have agreed that this amount be refunded to the appellant. Learned counsel for the respondent endorses the submission made by learned counsel for the appellant.

In view of submissions of learned counsel for parties, this appeal is dismissed as withdrawn being infructuous. The amount of `1 lac deposited by the appellant is ordered to be refunded to him as per terms and conditions of compromise dated 15.09.2016.
