The second appeal is at the instance of the plaintiff whose suit for declaration that the sale deed executed by the 1st respondent in his favour was not valid and he had purported to take a sale in respect of property of which he was not the owner. The plaintiff had not even stepped into the witness box and the trial Court drew an adverse inference against the plaintiff. This was affirmed in the appeal by the Appellate Court.

I find nothing substantial in the second appeal for consideration and it is dismissed.
