Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents, after the Rule 10 of The HCS (RP) Rules, 2008 dated 30.12.2008 (Annexure P-2) since already quashed by this Court in CWP No.14857 of 2023, titled as "Jagdish Raj Gupta vs State of Haryana and others", on 31.05.2024 (Annexure P-6) to the extent provides for uniform date of increment i.e. 1st of July of every year one annual increment to the petitioners. Further direction be issued to the respondents to refix the pension of the petitioners by granting them annual increment in their last retiring year i.e. 2015, with all consequential benefits of arrears of pay and pension, etc. along with interest @ 12% per annum.

Learned counsel for the petitioners, at the very outset, confines his prayer for deciding legal notice dated 12.05.2024 MOHD YAKUB 2024.08.28 18:30 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh
CWP No.20982 of 2024 (O&M) (Annexure P-5). He submits that at this stage, petitioners would be satisfied, if the said representation/legal notice is decided by passing a speaking order within a time bound frame.

Mr. Saurabh Mohunta, DAG, Haryana, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.4 to decide legal notice dated 12.05.2024 (Annexure P-5), submitted by the petitioners expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
