' for grant of regular bail in FIR No.315 dated 17.05.2023 under Section 306 IPC registered at Police Station City Ballabgarh, District Faridabad. 2.
Facts of the case are Pramod Singh complainant gave his statement that marriage of his daughter Bina Devi was performed with Mahesh. She was having three sons out of this wedlock. Thereafter his daughter started residing at Bhagat Singh Colony, Ballabgarh with one Chandan son of Sudhir Singh i.e present petitioner. Said Chandan used to beat his daughter due to which she committed suicide on 15.05.2023 by hanging. She took this step due to the harassment and beating given by said Chandan.
3.
Learned counsel for petitioner argued that petitioner is behind the bars since 18.05.2023. Allegations levelled against petitioner are general in nature. In-fact, they were in live-in relationship. Prior to this, there was no complaint. Statements of material witnesses have been recorded i.e. complainant Parmod (PW2), brother of deceased victim Manoj Kumar (PW3) which are Annexures A-2 and A-1 respectively. Trial in this case may take long time. He will abide by the terms of bail order. Therefore, his regular bail application may be allowed.
4.
Bail application is opposed by learned counsel representing State. Status report has been filed confirming the facts detailed in the FIR. It is pointed out that after completion of investigation challan was prepared and presented before Illaqa Magistrate on 10.07.2023. Case was committed
' to the Sessions Court, Faridabad. Chargesheet was framed on 05.10.2024. Out of 14 prosecution witnesses, at present 3 witnesses have been examined. Custody certificate is also annexed according to which petitioner is behind the bars for 1 year 5 months and 26 days which is Annexure R-3. Considering gravity of offence, regular bail application filed by petitioner is opposed.
5.
I have considered the arguments and have gone through the record. Admittedly, the victim Bina Devi died unnatural death while staying with present petitioner. He is facing trial under Section 306 of IPC. Chargesheet was framed on 05.10.2024 and both material witnesses have been examined i.e. Pramod (PW-2) and Manoj Kumar (PW-3). Other witnesses are yet to be examined. Trial in this case may take long time. Now petitioner cannot influence the material witnesses.
