The appellant was selected and appointed on the post of Assistant Manager (Press) on 21.10.1997 in the Kurukshetra University. His selection was challenged by respondent No.1&2 through a writ petition filed in the year 1997 which was allowed by learned Single Judge on 31.10.2013 quashing the appellant's selection, with a further direction to consider respondent No.1 for such appointment, if he was found suitable. The claim of respondent No.2 (petitioner No.2 in the writ petition) was rejected. (2)
The aggrieved appellant filed the instant appeal in which operation of the order of learned Single Judge was stayed on 11.03.2014. Consequently, the appellant continued on the post of Assistant Manager (Press). He has now retired on attaining the age of superannuation on 31.07.2014.

In the light of the subsequent events, namely, that the appellant has retired from service while holding the post of Assistant Manager (Press), we dispose of this appeal as infructuous but with a clarificatory direction that the appellant shall be taken to have retired as Assistant Manager (Press) for all intents and purposes including for the post-retiral benefits. (4)
