Learned counsel for the petitioner submitted that the appeal against the order of assessment passed by the Excise and Taxation Officercum-Assessing Authority, Panchkula, has been decided after filing of the present petition, he may be permitted to withdraw the present writ petition with liberty to avail of remedy of appeal against the order passed by the First Appellate Authority.
