Prayer in this petition is for setting aside order dated 17.08.2017 whereby plea of the petitioner for pre-mature release has been rejected.

At the outset, learned State counsel submits that case of the petitioner for release from custody shall be considered afresh by the concerned authority and decision shall be taken at the earliest, in any case not later than two weeks.

In view of above, learned counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to file afresh in case any fresh cause of action arises.
