CM-3128-2026 has been filed by the respondent for dismissal of the instant petition as having been rendered infructuous in view of order dated 29.09.2023 having been passed during the pendency of writ petition. 2.

Learned counsel appearing for the applicant submits that the copy of order dated 29.09.2023 has been supplied to the petitioner on the date of passing of order itself.

Learned counsel for the petitioner upon being confronted with the same, has expressed his ignorance regarding the passing of the said order and whether order has been complied with or not.

Be that as it may, the order passed by the respondent is annexed with the application as R-1 cannot be overlooked and there is no reason to disbelieve the respondent-Board any further.

Accordingly, the present petition stands disposed of as having been rendered infructuous. In case, petitioner is still aggrieved by any remaining relief, which is prayed in the instant petition though this Court has not granted the same at this stage, the petitioner would be at liberty to claim the same by moving a representation to the respondent within a period of one month from today, which shall be decided by the respondent in the next four weeks thereafter by passing a speaking order. 6.

In view of the fact that the application for dismissal of the writ petition as has been rendered infructuous discloses that the necessary relief was granted as far back as 29.09.2023 but the same was withheld from the notice of the Court, costs of Rs.25,000/- imposed by this Court vide order dated 13.11.2025, stands waived off.

Pending miscellaneous application, if any, shall also stands disposed of.
