The petitioner's application for the grant of an adjournment filed before the Court of first instance has been dismissed on 08.08.2023. The Court has also closed the opportunity of the petitioner (plaintiff) to lead evidence on the ground that she has been granted nine effective opportunities during the period of last five months. The petitioner appears in person and submits that on account of her health, she could not lead evidence and undertakes to produce her entire evidence on the next date of hearing i.e. 15.09.2023.

This Court has considered the submissions. The Appellate court has remanded the case back to the trial Court for deciding afresh. The petitioner undertakes to produce her entire evidence on the next date of hearing i.e. 15.09.2023.

Keeping in view the aforesaid facts, the impugned order is modified subject to the condition that the petitioner will produce her entire DEEPAK KUMAR BHARDWAJ 2023.08.31 15:48 I attest to the accuracy and integrity of this document evidence on 15.09.2023, failing which the revision petition shall be deemed
