Case has been called out twice. But there is no representation on behalf of the appellant. Even on the previous date of hearing, there was no representation. Prior to that, the application for condonation of delay had been dismissed in default, by this Court, on 21.7.2015 but was restored on 31.7.2015. Having regard to the irregular conduct of the appellant when on earlier occasion, the matter was dismissed for want of prosecution but the lapse was condoned and yet the appellant has repeated the lapse, we would not deem it appropriate to keep the appeal alive any further.
