**** RAJ MOHAN SINGH, J. (Oral) Admittedly, there is an exparte award against the petitioner. Petitioner has not preferred any objection under Section 34 of Arbitration and Conciliation Act, 1996 before the concerned Court. The execution is pending where the property of the petitioner is going to be auctioned. Since the award is to be executed as a civil Court decree, therefore, no stay can be granted in view of proviso to Section 36(3) of the Arbitration and Conciliation Act, 1996.
Petitioner, if so advised may approach the concerned Court to show his readiness and willingness to pay the entire decretal amount along with interest till date. Dismissed.
