By virtue of instant petition, preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ especially in the nature of mandamus directing the respondents to extend the benefit of re-exercise/change of option within some reasonable period for the grant of revised pay-scales w.e.f. 01.01.1986 in view of the changed circumstances in Masters scale vide notification dated 24.12.1992 (P-1) of the Finance Department as has been done in the cases of employees working in the Government Schools and to pay the consequential benefits along with interest @ 18% p.a.

Learned counsel for the petitioners contends that though legal notice dated 01.03.2018 (P-6) was duly served upon the respondents but till date neither any reply to the said legal notice has been received nor any conscious decision has been taken by the respondents. CWP No.9492 OF 2018 --2-- feel satisfied in case direction is issued to respondent No.2 to decide their legal notice (P-6) in a time bound manner.

Accordingly, instant petition is disposed of with a direction to respondent No.2-Director of Public Instruction (S), Punjab School Education Board, Phase-8, SAS Nagar Mohali to look into the grievances unfolded by the petitioners in legal notice (P-6) and to take a conscious decision in accordance with law within a period of four months from the date of receipt of a certified copy of this order.

However, if petitioners still feel aggrieved against any of the order(s) passed by the aforesaid authority, they shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
