The present revision petition has been filed challenging the order dated 22.12.2022 whereby the Rent Controller has directed that the rent be deposited from April 2023 onwards in the Court in view of a dispute between the members of the Trust.

Learned counsel appearing on behalf of the petitioner would contend that the rent has already been received by Navjot Singh, who is one of the trustees, and that he has also been issuing receipts since February 2015.

In the present case though a categoric stand was taken by the petitioner herein that the amount has been paid to Navjot Singh, who is allegedly a trustee, however, the said fact is denied by the respondent who JITENDER KUMAR 2024.02.12 10:44 I attest to the accuracy and integrity of this order/judgment Chandigarh

CR No.6029 of 2023 -2- 2024:PHHC:018774 stated that Navjot Singh is neither a trustee nor he was ever authorized by the Trust to collect the rent. Further still, neither before the Rent Controller nor before this Court there is any document to substantiate the stand taken by the petitioner that the amount was paid to Navjot Singh. In the absence of any documentary proof that the amount was paid to Navjot Singh, at this stage no fault can be found with the order dated 22.12.2022 passed by the Rent Controller. Needless to say that if the amount, at a later stage, is found to have been paid the same would be adjusted in accordance with the law. 5.

In view of the above, the present revision petition is accordingly dismissed being devoid of any merits. Pending applications, if any, also stand disposed off.
