In the instant petition, prayer has been made for quashing of FIR No. 467 dated 23.10.2010, under Sections 419, 420, 467, 468, 471 IPC, registered at Police Station Civil Lines, District Amritsar.

During the pendency of the instant lis, CRM-41846-2021 and CRM-41849-2021, were filed on behalf of Jaswinder Kaur and Balwinder Singh for their impleadment as respondent Nos. 2 and 3 and also made a prayer for taking appropriate action against the petitioner for impersonating as Ajit Kaur, who alleged to have died on 19.7.2010. Various disputed questions of facts have been raised by the learned counsel for both the parties. So far as the main prayer DALBIR SINGH TIWANA 2023.11.23 14:53 I attest to the accuracy and authenticity of this order/judgment.

2023:PHHC:148352 CRM-M-49733-2021 (O&M) as raised in the main petition is concerned, the learned counsel for the petitioner has submitted that he may be permitted to withdraw the instant petition with liberty to raise all such pleas before the trial court at the appropriate stage.

Learned State counsel, on instructions imparted to him by ASI Surjit Singh, informed this Court that the investigation was completed way back in the year 2017 when supplementary final report was filed. Thereafter, the charges were framed on 11.9.2017 and total 9 prosecution witnesses have been examined out of 19 witnesses cited in the final report.

Considering the advance stage of the trial, at this stage, this Court is not inclined to interfere, that too with the disputed questions of facts. The instant petition is dismissed as withdrawn with liberty to the petitioner to raise all such pleas before the learned trial court, at the appropriate stage.

So far as CRM-41846-2021 and CRM-41849-2021 are concerned, these are also disposed of with the liberty to the applicants to raise all these pleas before appropriate forum/court at appropriate stage and also avail the alternative remedy, if any, in accordance with law.
