(ORAL) The petitioner herein seeks the indulgence of this Court for the issuance of a writ in the nature of mandamus for the extension of his parole for a period of two more months, while averring that he was convicted in the criminal case arising out of the FIR bearing No.91 dated 06.08.2015 registered at Police Station Mamdot under Section 489-A/B/C IPC and Section 21 of the NDPS Act and also in another case registered vide FIR No.155 dated 20.06.2015 at Police Station Sadar, Ferozepur, under Section 25 of the Arms Act. He was released on parole on 02.10.2021 for a period of 56 days but presently, he is suffering from dengue fever. Heard.

moved this application to the Deputy Commissioner, Tarn Taran, with the same prayer as made in this petition but he has not placed any document on the record to show that the above-said addressee authority has decided the same. Moreover, no material is available on the file to come to the conclusion that if the petitioner surrenders in the Jail, his medical condition cannot be dealt with and handled/taken care of by the doctor deputed in the concerned Jail or proper treatment cannot be made available to him by the Jail Authorities.

In view of the above-discussed facts and circumstances, this Court is of the considered opinion that the instant petition, being sans merit, deserves dismissal. Resultantly, the same stands dismissed accordingly. (MEENAKSHI I. MEHTA) JUDGE 26.11.2021.
