In the present petition, the petitioner has prayed for issuance of a writ in the nature of Certiorari for quashing the order dated 08.07.2022 (Annexure P-7) passed by respondent No.2, whereby punishment of stoppage of two annual grade increments with future effect was imposed and also for recovery of 1/3rd share of total loss of Rs.63,452/- which was asked to be recovered from the petitioner. 2.

At the outset, learned counsel for the petitioner submits that he confines his prayer only in regard to the order dated 02.11.2023 (Annexure P-9) passed by the Appellate Authority. Learned counsel submits that a perusal of the same would show that all the contentions raised by the petitioner were not considered while passing the abovesaid order by the Appellate Authority. He also submits that perusal of the abovesaid order dated 02.11.2023 (Annexure P-9) would show that once the Appellate Authority has given a finding that the DIWAKER GULATI 2025.07.21 15:11 I attest to the accuracy and integrity of this document -1-



 punishment imposed on petitioner is on higher side and same can be reconsidered, in that case, it was obligatory on the part of Appellate Authority to consider the abovesaid aspect and decide the appeal. 3.

Mr. Arpandeep Narula, Advocate, accepts notice and files Memo of Appearance on behalf of the respondents, which is taken on record.

Learned counsel for the respondents, in all fairness, submits that the respondents will pass a fresh order in appeal taking into consideration all the contentions raised by the petitioner and the decision will be taken by the Appellate Authority in appeal within a period of one month from today.
