Present petition under Section 482 Cr.P.C. for quashing of order dated 09.01.2017 (Annexure P5), passed by the learned Sub Divisional Judicial Magistrate, Phillaur, whereby petitioner was declared as proclaimed offender in case FIR No. 162 dated 14.08.2012, registered under Sections 406 & 420 IPC at Police Station Phillaur, District Jalandhar. Learned counsel for the petitioner contended that earlier, petitioner was released on bail vide order dated 10.09.2012 (Annexure P2) by the learned trial Court and thereafter, he was declared as proclaimed offender vide order dated 09.01.2017 (Annexure P5). However, the record of the learned trial Court is not available with this Court. Notice of motion.

In the light of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to regular bail, the learned trial Judge shall decide the same within a period of 15 days, thereafter.
