***** HARSH BUNGER J. (Oral) Petition herein is, inter alia, seeking a writ in the nature of Certiorari, for setting aside the order dated 22.09.2010 (Annexure P-6) passed by learned Collector, Kurukshetra, whereby respondent No.5 - Jagga Ram was appointed as the Lambardar of village Nayasi, Teshil Pehowa, District Kurukshetra.

1.1 A further prayer has been made for setting aside the order dated 27.07.2011 (Annexure P-7) passed by learned Commissioner, Ambala

CWP-26524-2019 (O&M) -2Division, Ambala, and order dated 20.09.2018 (Annexure P-9) passed by learned Financial Commissioner, Punjab whereby the appeals and revision preferred by the petitioner was dismissed.

Learned counsel appearing for the petitioner as well as the learned counsel appearing for respondent No.5 have stated that, respondent No.5 - Jagga Ram who was appointed as the Lambardar of village Nayasi, Teshil Pehowa, District Kurukshetra by learned Collector; which was further affirmed by learned Commissioner as well as learned Financial Commissioner, has already expired.

Learned counsel for the petitioner submits that in view of the aforesaid fact that respondent No.5 - Sh. Jagga Ram has already expired, he would not press this petition; however, he prays that appropriate direction be issued for filling up the vacant post of Lambardar of village Nayasi, Teshil Pehowa, District Kurukshetra, and also permitting the petitioner to apply for the aforesaid vacant post.

Learned State counsel has not opposed the aforesaid course being adopted.

Keeping in view the above, the present petition is disposed of as not pressed; however, since the aforesaid appointed Lambardar - Sh. Jagga Ram has already expired, learned Collector, Kurukshetra is directed to initiate fresh proceedings by carrying out fresh proclamation in the village Nayasi, Teshil Pehowa, District Kurukshetra to appoint suitable candidate as Lambardar, in accordance with law.

CWP-26524-2019 (O&M) -36. The present writ petition is disposed of in aforestated terms. 7.
