*** Present: Mr. H.S. Jaswal, Advocate for the petitioner Mr. Manish Dadwal, AAG Haryana -.- Raj Mohan Singh, J . (Oral) The petitioner has preferred this petition for extension of parole, which was granted to him for a period of 42 days. The period of parole shall expire today itself.
Learned counsel for the petitioner submits that total period of parole can be availed in two parts, maximum period of parole is of 70 days and it can be availed in two parts. For remaining part of the parole, liberty may be granted to the petitioner to move a specific representation with reference to the ailment with which his wife is suffering and in the event of filing such a representation the same may be directed to be disposed of in a time bound manner. Learned State counsel on instructions from Inspector Lalit, SHO City Karnal submits that under Section 11(5) of the Haryana NEHA 2023.09.11 14:37 I attest to the accuracy and integrity of this order/judgment
2023:PHHC:117224-DB CRWP-8604-2023 (O&M) -2Good Conduct Prisoners (Temporary Release) Act, 2022, no extension is permissible under the law.
Learned counsel for the petitioner, however, relies upon order passed in CRWP-3955-2022 in the context of extension of parole.
In view of the facts and circumstances of this case, we deem it appropriate to relegate the petitioner to file a representation before the competent authority within a period of three days. In the event of filing of such a representation, the competent authority shall consider the same within a further period of two weeks in accordance with law.
The petition stands disposed of.
