Present petition under Article 227 of the Constitution of India whereby petitioners sought writ in the nature of mandamus directing the official respondents to consider and decide their pending claim especially legal notice dated 13.12.2017 (Annexure P8) for revision of pensionary benefits/pay along with arrears by notionally promoting them with effect from the date of promotion of their juniors in terms of the Punjab Roadways (Operational) State Service Class-III (First Amendment) Rules, 2000 and for grant of any consequential relief in terms thereof. Learned counsel for the petitioners, at the time of arguments restricted his prayer and sought relief to the extent that legal notice dated 13.12.2017 (Annexure P8) is pending with the respondents and no decision has been taken by now and they be directed to take a conscious decision on the same.

Civil Writ Petition No. 9690 of 2018 motion is being issued. Rather present petition is disposed of with the direction to the respondents to consider the legal notice dated 13.12.2017 (Annexure P8) and take a conscious decision in terms of the Rules & Regulations and the instructions applicable to the petitioners within a period of three months from the date of receipt of a certified copy of this order. However, in case, the petitioners still feel aggrieved of the order passed by the concerned authority, they shall be at liberty to approach this Court.
