Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.352 dated 05.08.2019 under Sections 20 and 29 of the NDPS Act, registered at Police Station Baldev Nagar, District Ambala.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per allegations in the FIR, 1.5 kgs. of ganja has been recovered from one Kaka. The name of the petitioner has surfaced in the disclosure statement suffered by said Kaka.

CRM No.M-39235 of 2019 -2Vide order dated 16.09.2019, interim bail was granted to the petitioner and he was directed to join the investigation. Learned State counsel, on instructions from ASI Ram Samoj, states that the petitioner has joined the investigation. In view of the above, the present petition is allowed. The order dated 16.09.2019, granting interim bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by conditions of Sections 438(2) Cr.P.C.
