Present petition under Section 439(2) Cr.P.C. for cancellation of bail granted to respondent No.2, namely Phool Kanwar by this Court vide order dated 27.08.2019 passed in petition i.e. CRM-M-29038-2019 on the ground that the said order was passed on the misrepresentation having been made by the Investigating Officer that out of 40 witnesses, 25 have been examined, which is factually incorrect and as such, bail granted to respondent No.2 in this case be cancelled.

Having considered the record available on the file, this Court passed order on 27.08.2019 primarily on the ground that material witnesses have already been examined on the date fixed and the said fact has not been controverted by learned counsel for the petitioner. As such, no ground is made out to cancel the bail granted to respondent No.2 by this Court and present petition stands dismissed.
