Letters Patent Appeal No.1344 of 2015 The appellant challenges order dated 10.7.2015 dismissing his writ petition as well as orders passed by revenue authorities appointing respondent no.4 as Lambardar. Counsel for the appellant submits that revenue authorities did not examine the respective merits and as respondent no.4 is facing a criminal trial, his appointment as Lambardar stands vitiated. Letters Patent Appeal No.1344 of 2015 (O&M) 2 We have heard counsel for the appellant, perused the impugned order as well as orders passed by revenue authorities and find no reason to entertain the appeal. The power to appoint a Lambardar vests with the Collector. The appointment, so made, can only be interfered by an appellate/revisional authorities or by this court if selection is contrary to the rules, perverse or arbitrary. The appellant's contention that respondent no.4 is facing a criminal case registered under Sections 323/325 and 506 of the Indian Penal Code has been considered and dealt with by the authorities as well as in the impugned order. Even otherwise, criminal case has been registered only under sections 323/325 and 506 of the Indian Penal Code.
