Titled as "Arshad Vs. Mohd. Wajid"

CNR No.HRPL010056642024 Seeking quashing of order dated 31.07.2024 passed by learned Additional Sessions Judge, Palwal in above cited criminal appeal to the extent of deposit of 20% of the compensation amount while suspending sentence, the petitioner had come up before this Court under section 528, BNSS, 2023.

Counsel for the complainant opposes the present petition on the ground that the petitioner is financially well off, and was even contesting the elections. 3.

Petitioner who is present in Court submits that the amount of compensation be reduced to 10%.

Counsel for the complainant submits that the petitioner is lingering on the matter on one pretext or the other.

After going through the affidavit so filed, the present petition is disposed of with observations that in the larger interest of equity and justice and fair play and considering Sonia Puri 2024.11.28 10:40 I attest to the accuracy and integrity of this document

CRM-M-41779-2024 the financial capacity of the petitioner, the amount of 20% is reduced to 10% and the petitioner-Arshad to deposit a sum of Rs.90,000/- on or before 07.01.2025. Impugned order is modified to that extent.

It is clarified that in case the amount is not deposited by the given date, then this order shall be recalled automatically without any reference to this Court by resorting to power under Section 403 BNSS read with section 528 BNSS, 2023. Petition stands disposed of with the aforesaid modification in the impugned order. All pending applications, if any, stand disposed.
