H.S. Grewal, J. (Oral) The present petition has been filed under Section 483 of Bharatiya -1Nagarik Suraksha Sanhita (BNSS), seeking regular bail in FIR No.21 dated 01.03.2023 under Sections 15/ 61/ 85 of NDPS Act, 1985 registered at Police Station Sandaur, District Malerkotla.

The case of the prosecution is that the petitioner alongwith his coaccused namely Amandeep Singh @Pamma has been found in possession of 20 Kgs of poppy husk in a vehicle which was being driven by his co-accused and the petitioner was riding as a passenger in the said vehicle. 3.
Learned counsel for the petitioner contends that the petitioner is in custody for the period of 02 years, 05 months and 21 days. She further submits that out of 19 cited prosecution witnesses, only 01 has been examined so far. She further submits that the co-accused namely Amandeep Singh @ Pamma has already been granted the concession of regular bail vide order dated 12.07.2024 (Annexure P-2) passed in CRM-M-32076-2024, by a Coordinate Bench of this Court.

Learned counsel for the State by way of filing of custody -2certificate, vehemently opposes the grant of concession of regular bail. He does not refute the fact that the petitioner is in custody for a period of 02 years, 05 months and 21 days and that out of 19 cited prosecution witnesses, only 01 has been examined so far.

I have heard learned counsel for the parties and have gone through the material placed on record.

Hence, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is granted the concession of regular bail, on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/ Chief Judicial Magistrate concerned. 8.
It is however, made clear that in case during his bail, if the petitioner indulges in any offence, the State shall be at liberty to file an application for cancellation of bail of the petitioner. 9.
