Municipal Council, Palwal through its Executive Officer .........Respondent
Present:
Mr. Johan Kumar, Advocate for the appellant.
CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.
Whether Reporters of local papers may be allowed to see the judgment ?
2.
To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
Delay of 27 days in filing the appeal is condoned. 2.
The appeal is by the plaintiff who lost his suit for declaration and for mandatory injunction bringing a challenge to the property tax assessed. The Court found that the demand had been made appropriately in conformity with law and there is no error for challenge through a suit. I find nothing substantial for intervention. The judgments are correct and upheld. The second appeal is dismissed. 3.
The counsel says that he shall have liberty to bring a fresh challenge if legal grounds are made for subsequent years. The plaintiff will have such liberty but any challenge will be examined afresh in the light of the grounds taken for any period of demand that could be brought for a challenge in accordance with law.
