**** ANOOP CHITKARA, J (ORAL) The limited prayer for which the petitioner has come up before this Court is for setting aside the impugned order dated 18.01.2020 (Annexure P-5), vide which the petitioner has been declared proclaimed person. The additional prayer made by the petitioner is for release of the petitioner on bail. Given the nature of the order, this Court proposes to pass that no instructions are required from the complainant. The explanation offered by the petitioner in Paragraph 10 of the petition is bona fide. The petitioner has promised to appear before the concerned Court on any date on or before 28.02.2022. Given such promising statement by the petitioner coupled with the Covid-19 Pandemic, the impugned order dated 18.01.

2020 (Annexure P-5) is hereby set aside subject to the condition that the petitioner shall appear before the concerned Court on the date mentioned above. Failure to appear before the learned trial Court on the date fixed, ipso facto automatically will result in recalling of this order without any further reference of this Court. Since the offences are bailable, as such, the concerned Court may seek fresh bail/surety bonds from the petitioner and shall positively release the petitioner on bail on furnishing requisite bail/surety bonds. Petition allowed.
