By this common order, CWP-20952-2024 and CWP-208542024 are disposed of as issues involved and prayer sought in both the petitions are common. For the sake of convenience and with the consent of parties, the facts are borrowed from CWP-20952-2024. 2.

The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to the Anju Goel 2024.08.28 17:03 I attest to the accuracy and integrity of this document Chandigarh

CWP-20952-2024 and Other connected matter respondents to recover gratuity of Rs.33,462/- along with interest from respondent No.5.

The controlling authority constituted under the Payment of Gratuity Act, 1972 by order dated 10.05.2023 directed respondent No.5M/s Lakhani Footwear Pvt. Ltd. to pay gratuity of Rs.33,462/- along with interest @ 9% per annum. The respondent No.5 did not pay the said amount and the petitioner approached labour authorities for execution of order. The labour authorities directed jurisdictional revenue authorities to recover the aforesaid amount as land revenue. The jurisdictional revenue authority has expressed its inability to recover the alleged amount on account of non-availability of property of respondent No.5 in its jurisdiction.

This Court cannot act as an Executing Court, nevertheless, is sanguine of the fact that the jurisdictional authorities would take appropriate steps for recovery of alleged amount as land revenue. 5.
