* * * ANIL KSHETARPAL, J. (ORAL) Petitioner prays for grant of regular bail in FIR No.309, dated 30.4.2019, registered under Sections 323, 324, 307, 506, 120-B and 34 IPC and under Section 25 of the Arms Act, at Police Station Assandh, District Karnal.
Learned counsel for the petitioner contends that as per the statement of Satish Kumar - injured, petitioner is alleged to have caused RAJ KUMAR ARORA 2019.09.19 17:20 I attest to the accuracy and integrity of this document
CRM-M-39306-2019 (O&M) injury on back of right knee which is not depicted in the medico legal report. He further submit that investigations are complete and police has filed final report and charges have been framed.
On the other hand, learned counsel for the first informant has submitted that Gaurav son of Satish has alleged that the petitioner has injured his father in the stomach with knife. Learned counsel for the State, on instructions from ASI Harbhajan Singh, submits that the petitioner is in custody since 30.4.2019 and is not involved in any other case.
Without commenting on the merits of the case and keeping in view the aforesaid fact that the petitioner is in custody since 30.4.2019 i.e. for more than 41⁄2 months, and the trial of the case is likely to take a long time, the petitioner is directed to be released on regular bail subject to furnishing of adequate surety to the satisfaction of the trial Court/Duty Magistrate.
Accordingly, the present petition is allowed with the aforesaid directions.
