(ORAL) Counsel for the petitioners argues that the petitioners are entitled for grant of interest on the delayed release of payment keeping in view the law laid down by this Court in CWP-15306 of 2016 titled as 'Hari Ram and others vs. Pepsu Road Transport Corporation, Nabha Road, Patiala', decided on 04.09.2017 (Annexure P-2). Counsel for the petitioners argues that the benefits as being claimed in the present writ petition have already been extended to the similar situated employees, who were the petitioners in Hari Ram's case (supra). Counsel prays that a direction be issued to the respondent to grant interest on the delayed release of pensionary benefits to the petitioners, for which they were entitled in respect of the services they rendered with the respondent. CWP-25756-2019 -2Counsel for the petitioners states that for the relief, which is being claimed in the present writ petition, the petitioners have served the respondent with legal notice dated 11.06.2019 (Annexure P-1), which is still pending consideration with the respondent and the petitioners shall be satisfied, at this stage, in case a time bound direction is issued to the respondent to decide the said legal notice.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioners, the respondent is directed to decide the legal notice dated 11.06.2019 (Annexure P-1) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.
Present writ petition stands disposed of.
