NIDHI GUPTA J. (Oral) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner during pendency of the trial in case FIR No.37 dated 15.1.2023, under Sections 323, 376, 342 and 506 IPC, registered at Police Station Rohtak City, District Rohtak.

Learned State counsel has filed the custody certificate dated 09/09/2023 in Court today, as per which petitioner has been in custody as undertrial for 04 months and 06 days. The same is taken on record. Copy thereof is supplied to the counsel opposite. After arguing for some time, when this Court was not inclined to grant any relief, learned counsel for the petitioner prays for withdrawal of the present petition.

Permitted to do so.
