The appellant assails the order dated 21.05.2015 whereby his writ petition seeking grant of Assured Career Progression (ACP) scale from the date his juniors were granted, i.e. 01.09.2009, has been dismissed. Facts are not in dispute. The appellant while working as Executive Engineer was served with a charge-sheet on 09.04.2009, which ended in imposition of punishment of stoppage of one increment without cumulative effect on 10.11.2009. The currency period of the punishment was, thus, till 09.11.2010. The claim of the juniors was considered and they were granted ACP. However, as the appellant was facing disciplinary action at that time, hence his case for grant of ACP was deferred as the same could be considered only after the expiry of punishment period. LPA-1091-2016 (O&M) -2been precisely done. He has been granted ACP after expiry of punishment period and was granted the same on 01.07.2011. For the reasons stated above, no interference with the order under appeals is called for.
