In view of the fact that in domestic enquiry the Enquiry Officer returned a categoric finding that Charges No.1, 2 and 3 having been proved against the appellant, Charge No.5, namely, that he has violated the Punjab School Education Board Employes Conduct Regulations, also stands proved against him, the disciplinary authority imposed punishment of stoppage of one increment without cumulative effect. The departmental appeal also failed. So was the fate of his writ petition challenging those orders. In this intra-Court appeal, the order of learned Single Judge is now under challenge. We have heard learned counsel for the appellant at a considerable length and gone through the record. LPA-1092-2016 (O&M) -2allegations against the appellant could not have been held to be proved in view of statements of witnesses. We are afraid that keeping in view the limited scope of judicial review, such like factual issues cannot be entertained. His second contention in respect of notice with regard to suspension period need not to be delved upon by us. The appellant will be at liberty to approach the competent authority for taking a sympathetic view and decide the fate of his suspension period.
