The order challenged in this appeal was passed with the consent of the parties. Learned counsel appearing on behalf of the appellant states that he never consented to the same. That, however, is for the learned single Judge to decide. In fact, the appellant filed an application for review on this ground. The review petition was, however, also dismissed. 2.

In the circumstances, we are bound to proceed on the basis that the order was passed by consent.

The appeal is, therefore, dismissed.

As we have dismissed the appeal itself, the delay in filing the appeal is condoned.
