(ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular to the petitioner in case FIR No. 45 dated 26.04.2023 (Annexure P-1) registered under Sections 354-A, 376 and 511 IPC at Police Station Division C, Police Commissionerate, District Amritsar. Learned counsel for the State has filed custody certificate dated 05.09.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 04 months and 08 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.
