The defendants are before this Court against concurrent findings of fact recorded by both the courts below, whereby the suit filed by the respondent/plaintiff for possession by way of specific performance of agreement to sell, was decreed.
The judgment of the learned lower appellate court is dated 1.9.2011. The appeal was preferred in this Court on 1.12.2011. Ever since the appeal was filed in the Court, the same is being adjourned either in the absence or on request of counsel for the appellants. The appeal was dismissed in default on 2.7.2015 and was restored on 5.8.2015. Today, the case was taken up twice, however, none has appeared for the appellants. As no arguments on merit have been addressed, the appeal is dismissed. For the purpose reference can be made to the judgment of Hon'ble the Supreme Court in Poonam v. Sumit Tanwar, 2010 (4) SCC 460.
