(ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.108 dated 17th of June, 2022 registered for the offences punishable under Sections 387 and 506 of the IPC, at Police Station Ranjit Avenue, District Police Commissionerate Amritsar.

Ld. Counsel for the petitioner submits that the petitioner has been nominated merely on the basis of Disclosure Statement suffered by coaccused and was not named in FIR. He is in custody since 26th of June, 2022. Investigation is complete and challan stands presented. There is no apprehension that the petitioner shall tamper with the evidence. 3.
Ld. State Counsel does not dispute the factual assertions based on record and further admits that the petitioner is a first time offender and is not involved in any other case.

I have heard Ld. Counsel for the parties and have gone through the records of the case.

Keeping in view the long incarceration already suffered by the petitioner and the fact that there is no direct evidence against the petitioner apart from the Disclosure Statement suffered by the co-accused and the fact that the investigation stands concluded, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/ surety bonds to the satisfaction of the Trial Court/Duty Magistrate, concerned.
