(Oral) One of the contention raised by the appellants is that the learned Single Judge has relied upon an un-amended Farman-i-shahi whereas after a subsequent amendment therein, the tenants are entitled to 100% ownership rights under that amended Farman-i-shahi.
As the alleged amended Farman-i-shahi was not brought on record before the learned Single Judge, it was obviously not taken into consideration.
As prayed for by learned counsel for the appellants, this letters patent appeal is dismissed as withdrawn at this stage with liberty to the appellants to move an appropriate application before the learned Single Judge alongwith the amended Farman-i-shahi, if any. Ordered accordingly.
