Mr. Suresh Singla, Advocate for the complainant. *** MANOJ BAJAJ, J.(ORAL) This petition has been filed by the petitioners under Section 438 Code of Criminal Procedure for grant of anticipatory bail in case FIR No.265 dated 25.08.2019 under Sections 365, 355, 379, 341, 323 and 34 IPC, registered at Police Station Talwandi Sabo, District Bathinda. The petitioners apprehended their arrest at the hands of Police. Learned counsel for the petitioners contends that the complainant was accompanying his friend Pritam Singh when the incident of beatings allegedly took place on 24.08.2019. It is contended that as per complainant, firstly beatings were given when Pritam Singh was present and thereafter the complainant was allegedly taken away by the assailants at a distant place where again beatings were given. He submits that the presence of said witnesses is doubtful because he did not intervene and this case has Sheetal Gawri 2019.09.24 19:31 I attest to the accuracy and integrity of this document Chandigarh been got registered due to political rivalry.
CRM-M-39038-2019(O & M) -2On the other hand, learned State counsel assisted by HC Gurwinder Singh has opposed the bail application. However, it is not disputed that the injury suffered by the victim are simple in nature. Considering the above background, it is ordered that in the event of arrest of the petitioners by the Arresting Officer, they shall be released on bail subject to their furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. They shall join investigation as and when called for by the Investigating Officer and would abide by the conditions enshrined under Section 438(2) Cr.P.C. The above order shall not be construed as an opinion on the merits of the case. The petition is allowed.
