ARUN MONGA, J. (ORAL) CM-1887-CII-2021 This is an application filed by the applicant-respondent No.3Insurance Company seeking preponement of the main case, which is pending for 01.04.2021 and disposal of the same on the basis of compromise arrived at between the parties. In the premise, application is allowed. Main case is taken up on Board for hearing today itself. FAO-337 of 2017 As per both the counsels, a mutual settlement has been arrived at. Per compromise, respondent No.3-insurance company will pay the enhanced compensation of Rs.4,00,000/- over and above the amount awarded by the Tribunal below as compensation to the appellants, to settle the issue.

The appeal stands disposed of in terms of compromise, ibid. The parties shall remain bound by the terms of the compromise which shall be treated as part and parcel of the Award. However, the appellants would be at liberty to reopen the matter in case of any default in payment on behalf of respondent No. 3.
