The principal contention raised in this appeal is that the post against which the respondent has been directed to be considered for promotion is actually meant for reserved category. We find from the order under appeal that no such plea was raised before the learned Single Judge. We thus cannot entertain a new plea at this stage. Faced with this, learned counsel for the appellant seeks to withdraw the appeal with liberty to file a review application before learned Single Judge. Ordered accordingly.
