On 21.07.2025, the following order was passed by this Court:- "1.
The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent to permit him to appear in B-1 promotion test for the year 2023 which is scheduled to be held on 27.07.2025 and 28.07.2025.

The petitioner was recruited as Constable in Haryana Police Force on 27.06.2017. He completed his 5 years regular service on 27.06.2022. He was entitled to be included in List B-1 as per Rule 13.7 of Punjab Police Rules, 1934 (for short 'PPR') (as applicable to State of Haryana). The B-1 test could not be conducted in 2023 due to administrative reasons. The
CWP No.20180 of 2025 -2Disciplinary Authority vide order dated 18.10.2023 awarded him punishment of stoppage of four future annual increments with permanent effect. The said punishment was awarded alleging negligence in handling a licensed weapon. He preferred appeal and Appellate Authority substituted awarded punishment by stoppage of three future annual increments with permanent effect. He is denied opportunity to participate in B-1 promotion test on the ground that he is suffering punishment.

Learned State counsel seeks time to get instructions.

The aforesaid order was followed by order dated 06.08.2025 which reads as under:-.
"
Learned counsel for the petitioner submits that petitioner attempted to participate in Mock Test, however, was no permitted. He may be permitted to participate in B-1 Test which is going to take place on 09/10.08.2025. He further submits that the petitioner is seeking permission to appear in B-1 Test and is not claiming right to participate in Lower School Course.

The petitioner is ordered to be permitted to participate in B-1 Test.

Learned State counsel seeks time to file reply on the question of right of the petitioner to participate in B-1 Test.

Adjourned to 26.08.2025."

Counsel for the parties are ad idem that petitioner was permitted to participate in B-1 Test and he has cleared the same. They further submit that instant petition, at this stage, has rendered infructuous. 4.
