S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):

The Labour Court and the learned single Judge did not accept the appellant's contention that he had worked for more than 240 days during the relevant period. The finding cannot be faulted. As noted by the Labour Court, the appellant did not even put his case regarding the record not having been furnished. It is, however, now contended that the appellant has further material which would establish his case. The material was obtained under the Right to Information Act.

The appellant's remedy, in that event, would be to file an application for review.

The appeal is accordingly disposed of.

As we have disposed of the appeal, the applications for condonation of delay in filing and re-filing the appeal are allowed.
