***** ARCHANA PURI, J. (Oral) As per the observations made in the order dated 24.09.2025, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/31/2025, titled 'Daljit Singh v/s Lovepreet Kaur', filed by the respondent-husband, pending in the Family Court, Jalandhar and she seeks transfer of the same to the Family Court, Nabha, District Patiala. Counsel for the applicant heard.

At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 20.10.2023 but no child born from the said wedlock. Also, it is submitted that soon after the marriage, the respondent proceeded to Spain on work permit and he has promised to call the applicant, but he did not do so and the applicant was maltreated and harassed by the in-laws family, on which Sonu 2025.10.18 09:43 I attest to the accuracy and authenticity of this document

TA-918-2025 account, she is residing at her parental place. It is further submitted that the applicant is not having any source of earning. She has filed petition under Section 144 of Bharatiya Nagarik Surkasha Sanhita, which is pending in Family Court, Nabha and the same is at the appearance stage. On query by the court, it is submitted that the applicant is not aware of the address of the respondent at Spain. In fact, it is pin pointed that the petition under Section 9 of Hindu Marriage Act, was also filed by the respondent, through his father, namely, Santokh Singh, attorney holder. The distance between the two places is stated to be about 150 kms.

In view of the constrained circumstances pin-pointed aforesaid, more particularly, considering the respondent himself residing abroad and filing the petition under Section 9 of Hindu Marriage Act, through attorney holder, it is just and expedient to accept the application. Hence, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/31/2025, titled 'Daljit Singh v/s Lovepreet Kaur', filed by the respondent-husband, stands transferred from the Family Court, Jalandhar, to the Family Court (Camp Court), Nabha, District Patiala. The requisite record of the aforesaid case be sent by the Family Court, Jalandhar, to the District and Sessions Judge, Patiala.

Learned District and Sessions Judge, Patiala, shall assign the said petition to the Family Court (Camp Court), Nabha. Even, the parties are directed to appear before the Family Court (Camp Court), Nabha, within a period of one month from today onwards.
