Learned counsel for the appellant, after arguing the appeal at length, submits that inadvertently the claim with regard to payment of subsistence/suspension allowance to which the appellant was statedly entitled to, could not be raised before the learned Single Judge. He seeks and is permitted to withdraw the appeal with liberty to submit a representation to the competent authority for release of subsistence allowance during the period when the appellant was under suspension or shall be deemed to be under suspension. If such a representation is made, the competent authority is directed to consider and decide the same by way of a reasoned order within a period of four months from the date it is submitted. However, no claim with regard to the benefits which have been declined by learned Single Judge shall be entertained.
