**** AMIT RAWAL, J. (ORAL) Petitioners are seeking indulgence of this Court for issuance of a writ in the nature of mandamus directing the respondent-Nigam to consider and promote the petitioners w.e.f. the dates their juniors have been promoted as Assistant Engineers in the 12.5% degree quota and grant all consequential benefits flowing therefrom viz. continuity of service, arrears of pay, seniority, promotions, interest thereon etc., and further writ of certiorari quashing the orders dated 17.03.2017 (Annexure P-3, Colly). In this regard, had submitted representations (Annexure P-9, Colly), but there is no adherence thereto.

Learned counsel for petitioners submits that he will be satisfied if a direction is issued to the respondents to consider the representations (Annexure P-9, Colly), within a stipulated period. Without going into the merits and demerits of the claim of the petitioners, I deem it appropriate to direct the respondents to consider the

YOGESH SHARMA 2019.09.24 09:51 I attest to the accuracy and integrity of this document CWP-26420-2019 (O&M) representations (Annexure P-9, Colly), within a period of two months from the date of receipt of certified copy of this order and shall pass a speaking order thereon, after affording opportunity of hearing to petitioners and taking into consideration judicial precedents as well, failing which, the respondents shall be liable to pay costs of `25,000/- to petitioners. In case, petitioners are found eligible for promotion, necessary orders be passed within one month thereafter.

This condition of imposing costs is only to prevent petitioners to run from pillar to post and avail remedy of contempt in case of noncompliance of directions issued by this Court.
