IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

Letters Patent Appeal No.174 of 2015 (O&M) DATE OF DECISION: 30.01.2015 Silver Lining Advertisers .....Appellant versus Amritsar Improvement Trust and another .....Respondents CORAM:- HON'BLE MR.JUSTICE S.J. VAZIFDAR, ACTING CHIEF JUSTICE HON'BLE MR. JUSTICE AUGUSTINE GEORGE MASIH Present: Mr. Jatin Salwan, Advocate for the appellant ..

S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):

This is an appeal against the order and judgment of the learned single Judge dated 05.12.2014 disposing of the writ petition without granting any reliefs.

2.

The order is based essentially on the finding that the period of the contract has expired. This finding, in turn, is on the basis that the contract was for a period of 5 years. It is fairly admitted that the copy of the contract annexed to the writ petition mentions the period as '5 years'. This, it is stated, was a typographical error and that the original document stipulates the period of 7 years.

3.

We see no reason why the appellant has not taken any steps for having the order corrected especially in view of the PARKASH CHAND 2015.01.30 17:16 I attest to the accuracy and authenticity of this document

LPA-174-2015 - 2 - fact that the error was on account of a typographical error in a document annexed to the petition itself.

4.

The appeal is accordingly disposed of with liberty to the appellant to have the impugned order corrected, modified or reviewed.

As the appeal has been disposed of, the application for condonation of delay in filing the appeal is allowed. (S.J. VAZIFDAR) ACTING CHIEF JUSTICE 30.01.2015 (AUGUSTINE GEORGE MASIH) parkash* JUDGE PARKASH CHAND 2015.01.30 17:16 I attest to the accuracy and authenticity of this document
