Mr. Rajinder Kr. Singla, Advocate for the appellant **** SURYA KANT, J. (Oral) (1) This Letters Patent Appeal challenges the order dated 09.12.2013 passed by learned Single Judge dismissing the appellant's writ petition.
The controversy pertains to appointment of Lamberdar of village Channia, Tehsil and District Faridkot. After analyzing the comparative merit of candidates, the choice of Collector fell upon respondent No.4. The appellant who happens to be the son of deceased Lamberdar (Surjit Singh) challenged that selection in appeal and then in revision petition before the Commissioner and Financial Commissioner, Revenue, Punjab, respectively but without any success. Similar was the fate of his writ petition which has been dismissed by the learned Single Judge.
(2) The Revenue authorities as well as the learned Single Judge have discarded the appellant's claim of being more meritorious, after noticing the fact that he was convicted in a V.VISHAL 2015.04.23 14:31 I attest to the accuracy and authenticity of this document
criminal case and sentenced to imprisonment for 11⁄2 years. In our considered view that single instance is sufficient to hold the appellant unsuitable for the office of Lamberdar. His allegation that respondent No.4 is also not a person with clean slate cannot be entertained in the light of appellant's own antecedents. In any case, there is no worth reliable evidence to substantiate the plea. (3) Dismissed.
