JUSTICE GURVINDER SINGH GILL Present:- Ms. Monika Singh, Advocate for Mr. Amit Kumar Jain, Advocate for the petitioner. ***** GURVINDER SINGH GILL, J.(Oral) The petitioner has approached this Court challenging order dated 24.7.2019, whereby the learned Principal Judge, Family Court, Jind has awarded interim maintenance @ `10,000/- per month during the pendency of proceedings under Section 125 Cr.P.C. The learned trial Court, while assessing the income of the petitioner as `25,000/- per month noticed the fact that the petitioner had admitted that he had gone to Australia to pursue Hotel Management Course and thereafter had also been serving in Maruti Company.

Keeping in view the educational qualification of the petitioner and also that he would be fairly well-off financially so as to afford education abroad, the assessment of the trial Court as regards the income of the petitioner @ `25,000/- per month cannot be said to be suffering from any infirmity. Consequently, in view of the aforesaid income, the interim Pankaj Kakkar 2019.09.

( 2 ) CRR(F)-687-2019 (O&M) maintenance as awarded @ `10,000/- per month is perfectly justified and does not warrant any interference. There is no merit in this petition and the same is hereby dismissed.
