(ORAL) The claim of the petitioner in the present writ petition is that he is a physically handicapped and he was entitled for the benefit of promotion in 3% vacancies, which have been reserved for the category of handicapped employees under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (for short 'Act of 1995') Counsel for the petitioner argues that petitioner was entitled for promotion to the post of Senior Account Officer under the said 3% quota, being fully eligible for the same, but the benefit has been denied to him without any valid justification.
Counsel for the petitioner prays that the direction be issued to the respondents to grant the benefit of promotion for the post of Sr. NARESH KUMAR 2019.09.18 14:57 I attest to the accuracy and integrity of this document Chandigarh
CWP-25927-2019 -2Accounts Officer with effect from the date the petitioner became entitled for promotion against the vacancies which came into being under Act of 1995 with all consequential benefits.
Counsel for the petitioner states that for the relief, which has been claimed in the present writ petition, the petitioner has submitted a representation dated 07.12.2017 (Annexure P-4) to the respondents, which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representation dated 07.12.2017 (Annexure P-4) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
